Caffeine: How FDA’s “Fresh Look,” Increased Congressional Scrutiny and Potential Litigation Will Affect Your Business
The FDA stated in April that the agency will take “a fresh look at the potential impact that the totality of new and easy sources of caffeine may have on health, particularly vulnerable populations such as children and youth, and if necessary, will take appropriate action.” In January, Senator Durbin, Senator Blumenthal and Congressman Markey sent letters to more than a dozen energy drink manufactures requesting the caffeine content of their products as well as other information regarding the marketing and regulatory positioning (food or dietary supplement) of their products. The City Attorney for San Francisco sued Monster Beverage in May for allegedly marketing its energy drink to children. In this session you’ll learn how these and other developments are affecting product development, marketing and distribution of products containing this controversial ingredient.

California: The Land of Regulation and Growing Class Actions
With the world’s ninth largest economy, California is a crucial market to many nutrition and supplement companies. However, doing business in California has never before been as complex, risky or costly as it is now. Proposition 65 lawsuits have increased and there are a growing number of class action lawsuits. And yet there may be hope, with Governor Brown proposing modifications to Proposition 65 and other laws.
